Terms of Service

These Terms of Service ("Terms") govern your use of Zombie AI Video, the website at zombieaivedio.com and its AI video generator (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.

1. The Service

Zombie AI Video lets you upload photos and generate short AI videos in the style of the "zombie love story" trend. In Love Story mode you upload two photos, and in Transformation mode you upload one. Videos are generated by third-party AI models (currently Kling O1, run through our provider fal.ai). Results are created automatically, vary from one generation to the next, and may not always match your expectations.

We may add, change or remove features, scenes, models or prices at any time. We'll try to give reasonable notice of significant changes.

2. Eligibility and accounts

• You must be at least 18 years old, or the age of majority where you live if that's higher, to use the Service.
• You're responsible for keeping your login details secure and for everything that happens under your account.
• Give us accurate information and keep it up to date.
• One person may not create multiple accounts to collect extra free credits.

3. Your photos: consent and likeness rights

Before every generation, you must confirm with the consent checkbox that you have the right to use the photos. By uploading a photo, you promise that:

• every person shown is you, or an adult (18+) who has given you permission to use their photo to make this kind of video;
• you own the photo or otherwise have the right to use it;
• your use of the photo doesn't violate anyone's privacy, publicity, likeness, copyright or other rights.

If someone asks you to delete a video of them, please do. If a person contacts us saying their image was used without consent, we may remove the photo and any related videos, and suspend the account.

4. Prohibited content and uses

You must not use the Service to upload, create or share:

• Any image of a minor (anyone under 18), for any reason, even with a parent's or guardian's consent.
• Photos of anyone who hasn't agreed to be in the video, including ex-partners, strangers, classmates or co-workers.
• Content that impersonates a real person, or uses a celebrity, politician or other public figure without permission.
• Deepfakes intended to deceive, such as videos presented as real events, fake news, fraud, scams or election-related misinformation.
• Sexual, nude or sexually suggestive content of any kind.
• Content intended to harass, bully, threaten, humiliate or defame anyone, including making someone into a zombie to mock them.
• Graphic violence, gore, self-harm, hate speech, or content that promotes illegal activity.
• Content that infringes someone else's intellectual property.

You also must not:

• try to bypass our safety filters, consent checks, rate limits or credit system;
• reverse-engineer, scrape or overload the Service, or access it through automated means except our official API, if offered;
• resell or redistribute the Service without our written permission.

We may use automated and manual checks to enforce these rules. We may refuse, block or delete any upload or video, and suspend or terminate accounts that break these Terms, without refund except where the law requires one. Where appropriate, we'll report illegal content, especially anything involving minors, to the authorities.

5. AI-generated content and labeling

All videos made with the Service are AI-generated and show events that never happened. When you share a video publicly, you agree to:

• clearly label it as AI-generated, for example by using TikTok's or Instagram's AI-generated content label, a caption or a hashtag;
• not present it as real footage or use it to mislead anyone;
• follow the rules of the platform you post it on.

6. Your content and license

You keep the rights you have in your photos. You give us a limited, worldwide, non-exclusive license to store, process and transmit them, including to our AI provider, only to provide the Service to you: generating your videos, storing them in your account, enforcing these Terms and complying with the law. We don't use your photos or videos to train AI models, and we don't publish them.

Generated videos. Subject to these Terms and to the rights of the people shown, you may download and use the videos you create for personal and social media use, including on monetised accounts. Videos are downloaded without a watermark. Because AI outputs can be similar between users, we can't guarantee that your video is unique or that you'll be able to register copyright in it.

7. Credits

• Generating a video uses credits: 50 credits for a 5-second video and 100 credits for a 10-second video. Prices may change, but the cost is always shown before you generate.
• New accounts receive free credits on sign-up. Free and promotional credits have no cash value.
• Credits are only spent when a video finishes successfully. If a generation fails, the credits are refunded automatically.
• Credits are a licence to use the Service, not money. They can't be transferred, sold or exchanged for cash, except as described in our Refund Policy.
• Credits may expire. Any expiry date is shown at purchase or in your account.

8. Payments and subscriptions

• Payments are processed by Stripe. By paying, you also agree to Stripe's terms. We don't store your full card details.
• Credit packs are one-time purchases.
• Subscriptions renew automatically each month and add credits at the start of each period, until you cancel. You can cancel at any time in your billing settings, and your plan stays active until the end of the current period.
• Prices are shown at checkout and may include applicable taxes.
• Refunds are covered by our Refund Policy.

9. Availability and changes

We work to keep the Service available, but we don't guarantee that it will be uninterrupted, error-free, or that every generation will succeed. AI providers may change or retire models, and we may switch to different models to keep the Service running.

10. Disclaimers

The Service and all videos are provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. AI-generated videos may contain errors, artifacts or unexpected results.

11. Limitation of liability

To the fullest extent the law allows, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law.

12. Indemnity

You agree to defend and indemnify us against claims, losses and costs (including reasonable legal fees) arising from the content you upload or create, your use of the Service, or your breach of these Terms, including any claim by a person whose image you used.

13. Termination

You can stop using the Service and delete your account at any time. We may suspend or terminate your access if you break these Terms, if we're required to by law, or if your use creates risk for us or other people. Sections that by their nature should survive termination (such as 4, 6, 10, 11 and 12) will survive.

14. Reporting misuse

If you see content made with the Service that uses your image without consent, involves a minor, or otherwise breaks these Terms, email support@zombieaivedio.com with as much detail as you can. We review every report.

15. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top shows when they last changed. For material changes, we'll notify you by email or on the site. If you keep using the Service after changes take effect, you accept the updated Terms.
